因應教育部「我國高等教務校務研究跨域整合資料庫之建置、分析應用、與綜效管理」計畫,需請同學們補填相關資料。緣起與法源依據說明,如下:

      在全球化浪潮的影響下,我國高等教育必須與世界各大學競爭以爭取傑出的教研人才與優秀的學生,促進大學的蓬勃發展,進而培育國家與世界的未來棟樑。因此,大學本身有必要長期性利用各項校務資料進行分析。基於校務資料所進行的校務研究或大數據分析,其重點在於能否發現「好的議題」、「有用的資料來源」與「適當的研究方法」,以創造出大學所需的分析成果。基於此,大學必須投入校務研究資料庫的建置、發展與蒐集,以累積辦學的知識庫。促使校務研究分析結果為大學的主管在校務政策與治理實務上,提供以數據資料為基礎的決策依據。
      本計畫擬提出一套考量資訊安全、去識別化與防火牆的全國性校務研究數據資料倉儲中心,開發與建置以個人原始資料為基礎的資料庫平臺,產出標準化定義的資料庫字典(Glossary),以及視覺化資料結構與國家級議題分析,以發展兼具系統性與邏輯性的學生學習歷程與學習成效之標準化資料架構平台。祈望透過整合全國大學校院校務系統的跨域數據資料庫平台,強化校務研究資料的可驗證性與應用價值,提升校務研究的成本效益以及校務治理的效率與效能,進而提供教育主管機構規劃關鍵性政策之參考,並與國際接軌及比較。
      由於本案涉及公私立大專校院對於個人資料之蒐集、處理及利用,依發文字號臺教高(二)字第1070095633號函文,適用法令條文說明如下:
(一)個人資料保護法第8條第2項略以:個人資料之蒐集係公務機關執行法定職務或非公務機關履行法定義務所必要者,得免為向當事人事前告知。
(二)個人資料保護法第15條及第19條略以:公務機關對個人資料之蒐集或處理;非公務機關對個人資料之蒐集或處理,除第 6 條第 1 項所規定資料外,應有特定目的。
(三)查法務部所列「個人資料保護法之特定目的及個人資料之類別」,包括「教育或訓練行政」(第109項)、「調查、統計與研究分析」(第157項),以及「學生(員)(含畢、結業生)資料管理」(第158項)等特定目的。本部或各校為進行全國性或學校性校務研究,所執行個人數據資料之蒐集、處理及利用,旨在提供各校持續改善教學品質及學生學習成效之用,並提升我國整體高等教育決策品質,兼有改善學生個人受教品質及增進公共利益之功能。各校配合本部規劃執行學生個人數據資料上傳,係屬個人資料保護法允許範圍。

In accordance with the Ministry of Education’s project, “Establishment, Analytic Application, and Synergic Management of Our Nation’s Higher Education Academic Affairs Institutional Research Interdisciplinary Integration Database,” students are required to fill in related information. The origin and source of law are explained as follows:

       Under the influence of globalization, our nation’s higher education has to compete with all universities around the globe in order to recruit outstanding teachers and researchers, and excellent students, to boost the development of a university, and to further cultivate future pillars of society for our nation and the world. Therefore, the university itself is required to take long-term advantage of miscellaneous institutional information and analyze it. Based on this institutional information, institutional research or big digital data analysis is conducted. The point is whether it can detect “good issues,” “useful sources” and “appropriate research methods,” to create analysis results that universities require. Based on this, universities must establish, develop, and collect the database of institutional research to develop a knowledge base of how to run schools. The outcome of institutional research analysis provides university supervisors with data information that can be used as a basis for decision-making on institutional policies and practical governance.
       This project proposes to offer a nationwide institutional research digital data-saving center that takes information safety, de-identification, and firewalls into account. Based on personal primary information, the center develops and establishes a database platform, produces a database glossary to be defined conventionally, visualizes data structure, and analyzes national issues. It is developed as a standardized information structure platform that contains both systematic and logical student learning processes and learning outcomes. Hopefully, by integrating interdisciplinary numeric database platforms of our nation’s universities’ institutional research systems, it can intensify the verifiability and valuable application of institutional research information, enhance the cost-effectiveness of institutional research, make institutional governance effective and efficient, and further offer references for education authorities to formulate crucial policies and link up with the world while comparing and contrasting with other nations’ policies.
        This project involves the collection, treatment, and use of personal information by national and private colleges, so according to the official document (code: 1070212230), it conforms to the following decrees:
1. Article 8, Paragraph 2 of the Personal Information Protection Act: If the collection of personal information is required by the government agency to exercise legal positions or for the non-government agency to fulfill legal obligations, there is no need to notify the person concerned in advance.
2. Article 15 and Article 19 of the Personal Information Protection Act: The government agency or non-government agency shall collect or process personal information with specific purposes, except the information stipulated by the first paragraph of the sixth article.
3. “The Specific Purposes of the Personal Information Protection Act and the Category of Personal Information,” listed by the Ministry of Justice, includes “Education or Training Ministry” (Paragraph 109), “Investigation, Statistics, and Research Analysis” (Paragraph 157), “Student (including graduates and those who have completed their courses) Information Management” (Paragraph 158), and so on. This Ministry and universities collect, process, and use personal data to conduct national or universities’ institutional research. This aims to offer all universities a frame of reference for continuously improving teaching quality and student learning outcomes, enhancing the quality of our nation’s higher education policy making, as well as improving the quality of education that students receive, and functioning for the advancement of public interests. The Personal Information Protection Act allows that all schools comply with the Ministry’s project to upload student personal digital data.
